Constitution

McHENRY COUNTY COLLEGE STAFF COUNCIL

Local #1642 IFT/AFT, AFL-CIO

 

ARTICLE I: NAME

This organization shall be known as the McHenry County College Staff Council, Local #1642 IFT/AFT, AFL-CIO.

ARTICLE II: STATEMENT OF PURPOSE

Section 1:

This council shall work toward the betterment of status, working conditions, skills, education and equitable salaries for all members.

Section 2:

This council shall also work with the administration and faculty of this college in a relationship of mutual assistance and cooperation so that students and community residents may achieve their goals, within the scope of the mission of the college.

Section 3:

This council shall be the exclusive bargaining agent for all eligible members.
 
ARTICLE III: MEMBERSHIP

Section 1:

The membership shall consist of: full and part-time classified and professional staff excluding Administrative Assistant to the President, Vice President of Administrative Services & Treasurer, and Vice President of Human Resources, Office Assistant in the President’s Office, all security personnel, and any position excluded from membership by the (IELRB) Illinois Education Labor Relations Board or the Staff Council contract.

Section 2:

There shall be no discrimination in condition of membership or voting rights based on race, religion, nationality, sex or age.

Section 3:

All members on paid leave shall be considered full members and shall pay full dues.

Section 4:

Associate membership shall be open to retirees or members on unpaid leave of absences. Associate members may attend general membership meeting and have the right to the floor, but shall not have the right to vote or hold office and need not pay dues.

ARTICLE IV: CONTRACT

Section 1:

All members in good standing shall receive a summary of the proposed contract seven (7) days in advance of the general membership meeting.

Section 2:

There will be a general membership meeting held to discuss the proposed contract.

Section 3:

The contract will be voted on by secret ballot on the next working day following the general meeting. The contract is ratified by a simplemajority of those members voting.
 
ARTICLE V: DUES

Section 1:

Annual council dues shall be set by Local #1642 at the May general meeting.

Section 2:

Assessments for unusual expenditures may be levied only by four-fifths vote of members in attendance.

ARTICLE VI: OFFICERS AND EXECUTIVE BOARD

Section 1:

The elected officers of this council shall be:

A. President

B. Vice-President

C. Secretary

D. Treasurer

E. Grievance Advocate

F. Building Representatives

Section 2:

The Executive Board shall consist of:

A. all elected officers of this council

B. all appointed chairs of standing committees

C. all elected building representatives, one from each building, and one representing personnel on third shift.

D. the immediate past president as an ex-officio member

Section 3:

The term of office for all officers, chairs and representatives shall be two

years.

ARTICLE VII: MEETINGS

Section 1:

A general membership meeting shall be held bimonthly. Other meetings may be called at the discretion of the Executive Board or by petition of twenty-five percent of the membership.

Section 2:

A quorum for general membership meeting shall be twenty percent.
 

ARTICLE VIII: PARLIAMENTARY AUTHORITY

"Robert's Rules of Order, Revised" shall govern in all cases not covered by the Constitution or by the By-Laws of this council.
 

ARTICLE IX: ENABLING ACT

This Constitution and By-Laws shall become effective when approved by a two-thirds affirmative vote.
 

ARTICLE X: AMENDMENTS

This Constitution and By-Laws may be amended by sealed balloting of affirmative vote by two-thirds of the membership provided notice and full text of the proposed amendment has been made available to the general membership at least two weeks prior to the scheduled balloting.

ARTICLE I: OFFICERS

Section 1:

General duties and responsibilities

A. The term of office for all officers shall be two years to commence on September 1 in each odd-numbered calendar year.

B. All officers must be members in good standing in the council for a minimum of one year prior to commencement of term.

C. All officers shall submit bimonthly reports to the general membership.

Section 2:

Specific duties and responsibilities

A. President

1. shall preside over all meetings of the general membership and Executive Board

2. shall be the spokesperson for the council on all public occasions and sign all necessary documents

3. shall serve as a member of the Negotiation Team

4. shall make appointments to committees unless otherwise stated in the By-Laws, and shall notify the general membership of such appointments.

5. shall serve as ex-officio member of all committees with the exception of the Audit Committee.

6. shall attend all MCC Board of Trustee meetings.

7. shall serve as a member of Local 1642 Executive Board.

B. Vice-President

1. shall assist the President at all times

2. shall preside over meetings of the general membership and Executive Board in the absence of the President

3. shall act as Parliamentarian at all meetings or appoint a Parliamentarian if acting in the position of President

4. shall attend MCC Board of Trustee meetings in the absence of the President

C. Secretary

1. shall record minutes of all meetings of general membership and Executive Board and distribute such minutes to appropriate members within fifteen calendar days

2. shall maintain official records and reports of the council

3. shall distribute all communications as directed by the President or Executive Board

4. shall notify members of regular or special meetings by preparing and publishing agendas.

D. Treasurer

1. shall receive, record and deposit all monies from dues and all other sources

2. shall make all authorized disbursements

3. shall keep complete records of all expenses and incomes

E. Grievance Advocate

1. shall be familiar with all aspects of the collective bargaining agreement and school policies

2. shall represent the council and its members in any grievance proceedings pursuant to the collective bargaining agreement in effect.

3. advise the Executive Board and membership as to the status of the grievance in process.

F. Building Representatives

1. Shall serve as union representatives in the building they work in.

2. Shall be responsible for distributing union material, and shall serve on the membership committee.

Section 3:

Vacancies

A. In the event an office shall become vacant for an officer who has served less than fifty percent of the term, there shall be a special election to fill the vacancy for the remainder of the original term.

B. In the event an office shall become vacant for an officer who has served more than fifty percent of the term, the President shall, with the approval of the Executive Board appoint a member to fill the vacancy for the remainder of the original term.

Section 4:

Recall

A. All officers are subject to removal from office for reason of negligence, breach of confidentiality, or malfeasance of office

B. Recall proceedings may begin only after a petition has been signed by fifty percent of the council membership and submitted to the Executive Board

C. The Executive Board must hold an investigation and open hearing by the next monthly meeting

D. Recall may occur only after two-thirds vote of those members present

Section 5:

Transfer of Records

Within ten days after the close of office, each officer shall transfer all records to the successor of that office. Any officer vacating an office shall transfer all records within ten days after the replacement is elected or appointed.

ARTICLE II: EXECUTIVE BOARD

Section 1:

Executive Board shall perform the following duties:

A. meet as needed to discuss complaints to see if they merit a grievance

B. discuss day -to-day business

C. decide if money is to be used for political campaigns

D. survey membership

E. shall investigate and hold recall hearings

F. shall approve presidential appointments to the negotiations Committee

G. shall approve presidential appointments to the nominating committee

H. screen amendments and establish procedures and set dates for the referendum on the proposed amendment
 

ARTICLE III: STANDING COMMITTEES

Section 1:

Grievance Committee shall consist of Grievance Advocate, President and three additional members as appointed by the Grievance Advocate. The grievance committee shall research and conduct grievances, and attend seminars and workshops dealing with grievance issues.

Section 2:

Membership Committee shall be responsible for recruiting new members and retaining present members. Shall be responsible for distributing union material to Building Representatives for distribution to members.

Section 3:

Newsletter Committee shall publish a union newsletter periodically.

Section 4:

Social Committee shall plan social events to help foster good will and a sense of togetherness.

Section 5:

Audit Committee shall audit the council's books annually to determine that all monies are accounted for.

Section 6:

Local Delegates shall attend county meetings once every two months (excluding summer) in Woodstock.

Section 7:

COPE Committee shall be the committee on political education.

Section 8:

Budget Committee shall prepare an annual budget.

Section 9:

Review Committee shall assist employees with the Job Review Appeal Process.

Section 10:

Scholarship Committee shall provide scholarship opportunities and coordinate fundraising efforts for the purpose of awarding scholarships to MCC students.

Section 11:

Sick Leave Pool Committee shall administer the Sick Leave Pool.

ARTICLE IV: SPECIAL COMMITTEES

Section 1:

Negotiations Committee

A. shall consist of the President and four members appointed by the President at least two months prior to the start of negotiations, with the approval of the Executive Board.

B. shall survey membership to obtain priorities to use in the negotiating process

C. shall assume responsibility for collective bargaining process

D. the President shall sign tentative agreements as part of the collective bargaining process

Section 2:

Nominating Committee

A. This committee of three is appointed by the President with the approval of the Executive Board during the month of May

B. The committee will encourage members to run for office and all nominations shall be accepted

C. No member shall be a candidate for more than one office in an election

D. Election by secret ballot, with provisions for absentee balloting, shall occur in July. It is the sole responsibility of the Committee to make all proper announcements involving the election, supervise the election, count the ballots and announce winners.

E. In case of a tie there will be a runoff election

F. Newly elected officers shall assume office on September 1

G. Candidates for the office of President must have been either a member of the MCCSC Executive Board for at least one (1) year or a member of either the Negotiating Committee or the Grievance Committee.

Section 3:

Other special committees may be appointed by the President with the approval of the Executive Board.

Section 4:

Staff Recognition Committee shall administer the nomination and voting processes for the annual award presented to one classified andone professional staff member.
